Shotgunn were on the STB leyline coming into mark 1 in the second race. Bow 80 were coming in on port in the zone of Mark one and tacked onto STB. Shotgunn had to sail above close hauled to avoid contact. Shotgunn hailed protest and put out the flag immediately.

Facts Found

1. Wind conditions at the time of the incident were approximately 7-8 knots from 230°. Wave: 0.3m
2. The incident occurred in the zone of Mark 1, the windward mark.
3. IOM 31 entered the zone sailing on starboard tack.
4. IOM 31 was approaching Mark 1 on the starboard layline, close-hauled on starboard tack to fetch the mark.
5. GER 80 approached the zone on port tack and tacked onto starboard inside the zone (2 boat lengths from the mark) at a distance from IOM 31 of 0.5m
6. IOM 31 had to sail above close-hauled to avoid contact with GER 80.
7. No contact, no boats take a penalty

Conclusions

• After GER 80 passed head to wind from port to starboard tack inside the zone and was then fetching the mark, she failed to give mark-room to IOM 31, who luffed and sailed above to close-hauled to avoid contact with GER 80. • GER 80 broke RRS 18.3.

GER 80 is disqualified from Race 2
