warrior won, Eker Suzme and Black Battalion were sailing upwind on Port with Warrior Won to windward, eker in the middle and black battalion to leeward Warrior Won and Eker were overlapped and separated by about 1 boat lengths, Eker and Black Battalion about 1.5- 2 boat lengths. Black Battalıon tacked without notice onto a collision course with us (Eker), Eker immediately hailed for room to tack to Warrior Wonthen when waited as long as possible before tacking.
Warrior Won did not begin tacking until Eker had passed head to wind and as such there was contact between the boats, because Black battalion was able to duck behind and also made contact to leeward in the same situation.
Eker retired from the race due to damage between the boats
We argue that Warrior Won did not give room to keep clear and respond to a hail to keep clear of a starboard boat.
